Newatik Terms & Conditons

1. Introduction

Welcome to Newatik. These Terms of Use (“Terms”) govern your access to and use of the Newatik platform (the “Platform”), operated by Newatik Ltd., a private limited company incorporated in England and Wales. By accessing or using our Platform, you agree to comply with and be bound by these Terms. Newatik operates as an intermediary platform, connecting professional businesses in the service industry to buy and sell second-hand furniture, fixtures, and equipment. We do not own, inspect, or sell any items directly and do not enter into contracts of sale between users.

2. Eligibility and Permitted Users

Newatik is designed exclusively for professional users operating in the service industry, including but not limited to the hospitality sector (restaurants, cafes, hotels), fitness and gym businesses, hair salons, and office environments. Listings from private individuals or businesses unrelated to these sectors are strictly prohibited and will not be accepted. You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.

3. Account Registration

To use Newatik, you must create an account, providing accurate and up-to-date information, including your name, email address, and business segment. You are responsible for safeguarding your account credentials and for all activities conducted under your account.

4. Listings and Content Moderation

All items listed for sale on Newatik must be relevant to the service industry sectors mentioned above. Newatik reviews each listing prior to publication. We reserve the right to reject or remove any listing at our sole discretion if it does not comply with these Terms, is irrelevant, or violates applicable laws or community standards. Listings must include clear, honest, and complete descriptions, with at least three high-quality photographs from multiple angles. Any defects, damage, or missing parts must be explicitly disclosed.

5. Prohibited Items

It is strictly prohibited to list, sell, or offer any illegal, counterfeit, hazardous, or otherwise prohibited items on Newatik. Newatik reserves the right to report illegal activities to relevant authorities and to remove any such listings immediately.

6. Payments and Fees

All transactions on Newatik are processed securely via Stripe. Payments are held in escrow until the buyer confirms satisfactory receipt of the item. Newatik charges an 8% commission fee to both the buyer and seller per successful transaction. Listing items is free; fees apply only when a sale is completed.

7. Shipping and Pick-Up

Pick-Up

Once a purchase is confirmed, the seller’s full address will be securely provided to the buyer by email. Buyers and sellers must agree on a collection date and time through Newatik’s internal messaging system.

Shipping

Newatik exclusively suggests and supports AnyVan for shipping. Buyers may choose to arrange shipping independently with AnyVan using the provided link and instructions on the Platform. While buyers may technically use other couriers at their own risk, Newatik assumes no responsibility or support for shipments made through any courier other than AnyVan. All shipping costs are fully borne by the buyer and are separate from the item price. Sellers are responsible for ensuring proper packaging and readiness of the item for collection. Newatik accepts no liability for loss, damage, or delays occurring during shipping.

8. SNAD (Significantly Not As Described) Policy

Definition An item is considered “Significantly Not As Described” (“SNAD”) if there is a substantial discrepancy between the listing description/photos and the actual item received. Examples include:

  • Receiving the wrong item.

  • Major undisclosed damage or defects.

  • Incorrect model, material, or size.

  • Missing essential components that affect usability.

Reporting SNAD

Buyers must inspect their item immediately upon receipt. SNAD claims must be reported to Newatik within 48 hours of delivery or pick-up confirmation, using the Platform’s messaging tool or the official support email.

Resolution Procedure

Direct Negotiation: Buyers should first attempt to resolve the issue directly with the seller via the messaging system.

Escalation to Newatik: If no resolution is reached, Newatik will mediate. Funds will remain in escrow during the investigation.

Return and Refund:

If a return is approved, the buyer must return the item in its original condition within 5 business days of receiving return instructions.

Return shipping costs are the responsibility of the buyer unless agreed otherwise with the seller.

Once the seller confirms receipt and condition, Newatik will release a full refund to the buyer, covering the item price and original shipping fee (if paid directly to the seller).

Refund Eligibility

Refunds are issued only in cases of confirmed SNAD claims. Refunds will not be issued for:

  • Change of mind.

  • Minor imperfections consistent with normal wear and tear.

  • Issues clearly disclosed in the original listing.

  • Claims submitted after the 48-hour reporting window.

9. Prohibited Conduct

Users must not:

  • Misrepresent items or provide false information.

  • Circumvent or avoid platform fees.

  • Use the Platform for any purpose unrelated to the permitted business sectors.

  • Harass, threaten, or defraud other users.

  • Engage in transactions outside the Platform to avoid fees.

10. Limitation of Liability

Newatik acts solely as an intermediary and does not inspect or verify items. We make no guarantees regarding the quality, safety, legality, or condition of items listed. Newatik is not responsible for any damages, losses, or disputes arising during shipping or pick-up, including but not limited to loss, delay, or damage in transit. Our total liability for any claim arising under these Terms shall not exceed the total commission fees received by Newatik for the disputed transaction.

11. Account Suspension and Termination

Newatik reserves the right to suspend or terminate any user account without prior notice for breaches of these Terms, illegal activity, or other misconduct. Users may request account closure at any time, provided all transactions are complete.

12. Privacy and Data Protection

User data is handled in accordance with our Privacy Policy. Personal data is used solely for facilitating transactions and maintaining the security and integrity of the Platform.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Users agree to first attempt resolution through Newatik’s internal dispute process. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Amendments

We reserve the right to amend these Terms at any time. Users will be notified of material changes at least 15 days before they take effect. Continued use of the Platform after this period constitutes acceptance of the updated Terms.

15. Final Acknowledgement

By using Newatik, you acknowledge that you have read, understood, and agreed to these Terms in full.
